The guy made a mistake. But the biker made a worse mistake. If he would have done that to me and my vehicle, there would be pieces of that bike scattered at least 100 yards down range. "Officer, when he kicked my mirror, it startled me so much I swerved because I was afraid I was going to hit him and unfortunately, my swerving to avoid him put me in his lane and I didn't see the parked motorcycle until I heard the impact." The car probably assumed the bike was far away and assuming that it’s going at a decent speed it was safe for it to turn but who would have thought the bike was moving way over the speed limit atleast from comparing it to other vehicles like the bus nearby I don’t think the car was much at fault other than just not making the right judgement on the speed on the oncoming bike but the bike was mostly at fault here for speeding even more so after smashing the cars mirror
