That 28mph limiter is firmware based too. If you replace the controller with one not locked (of only soft-locked) that 28mph becomes 50mph real quick.

28 is safer because it allows you to flow with traffic and most suburban cities speed limits are around 30mph. It's the illegal bikes that are causing problems. They are fun though, but parents are buying bikes that go 50mph for kids that can't even drive yet..

Delivery driver here. These things are a nightmare to deal with, mostly because people treat them like bicycles. Jetting out of their garage, switching between sidewalk and street, full sending through the cross walk.
