Forensics only work when cross referenced. They would need a reason to suspect him, then swab, then compare.
For thkse who don't know, its not that he littered, its that at the bottom there was a crime scene and the cops tought that the can was prob from the murderer or related to crime that was commited. Thats how they want to tell us to make sure trash goes into the trash can, so your dna doesn't go to a random crime scene, giving us a new fear that could happen.

My father is a lawyer He told me years ago about a case where there was a series of car break ins and this guy spontaneously touched the hood of one car while going back from work, that car ended up being broken in later that night, the cops came in to take fingerprints, the guy who touched the car got arrested and he happens to have previous theft convictions but my father told me he didn't do this one but the cops wouldn't believe him. He ended up being convicted. I never touch random cars on the street till this day.

1. This is only an issue if his DNA is in a criminal database 2. DNA at a scene is not conclusive enough to prove guilt, meaning it's unlikely prosecutors would bring a case against him even if a DNA match is found because they avoid cases they don't think they could secure a conviction on 3. In certain cases, DNA can be time-verified to a certain degree which would provide an alibi for the guy
