There is an element of this sort of smuggling which I didn't see in the clip provided, but adds some significant weight to the prosecution of the crime. The introduction of non-native species to an environment. While a red panda isn't going to harm the environment in any meaningful way, there is a market in illegal insects - animals that have the potential to be vastly more harmful to US agriculture. It's short sighted to bust a tobacco smuggler, or possibly the prosecutorial equivalent of "pork" - that is to say, pandering to a local electorate. To the farmers in, say, South Carolina, busting an illegal tobacco smuggler plays well. But the wrong bug introduced to an environment where it has no natural predators? Entire states might see their farming industry colapse. So signaling that you're willing to prosecute any animal smugglers to the extent of the law, it's warm and fuzzy when you rescue cute animals, but it sets a precedent, it makes other kinds of smuggling that much more risky.
